Who is considered a marketer?

In regard to regulations, a marketer (also called “producer”) is any natural or legal person who, for professional purposes:

  • produces oils in France;

  • sells own-brand oils in France;

  • imports or introduces oils for the first time onto the national market with a view to selling them to an end user or to directly using them on French territory;

  • imports or introduces onto the national market for the first time equipment containing oils, intended to be sold or used in France (automotive, trucks, machinery, etc.).

Products concerned: Mineral, synthetic or industrial oils and lubricants, likely to generate waste oils and corresponding to specific uses.

SIGNING AN AGREEMENT

Signed for a three-year period, the agreement defines the terms of our contractual relationship and the conditions according to which the producer responsibility organization will be involved within the scheme.

PAYMENT OF AN “ECO-FEE”

This financial contribution is collected by the producer responsibility organization from all of its marketer members. It is then redistributed in the form of funding to the scheme’s operators who collect and treat this waste. It also funds technical studies.

This eco-fee is not a tax but is part of your product’s production costs and is intended to fund the prevention and management of your waste oils.  Its amount is set in €/tonne and can be upwardly and downwardly adjusted every year.

MODULATING YOUR ECO-FEE

As from 1 January 2023, Cyclevia has set up an eco-fee adjustment system according to environmental performance criteria, called "eco-modulation”.

THE OBJECTIVES

The purpose of eco-modulation is to encourage producers to design finished products that can be easily collected, sorted, recycled, regenerated or that incorporate bases made from regenerated oils. The idea is also to reduce the number of products labelled as hazardous within product ranges.

SO HOW DOES IT WORK?

Eco-modulation will be applied in January 2024 during the annual adjustment. It’s simple: calculations are carried out once and generate few or no errors; It’s fair: the calculation is based on real quantities sold during the year.
